Terms and Conditions of the Improvisation Academy

Article 1 Definitions

  • Robijn Tilanus, i.e. (the contact person of) the Improvisation Academy, established in Uffelte (7975 AN), at Dorpsstraat 39, telephone +31 6 400 66 402, email robijntilanus@gmail.com, Chamber of Commerce no. 57689849, VAT no. NL 130354417B01: the user of these terms and conditions.
  • Music partner: any natural person and/or legal entity who attends a piano lesson, takes part in a workshop, course or training programme, or orders a book or CD from the Improvisation Academy.

Article 2 Mutual trust

  • The Improvisation Academy does business with its music partners solely and exclusively on the basis of mutual trust.
  • When a music partner attends a piano lesson, the Improvisation Academy trusts that the music partner pays the price agreed in advance, either immediately or, by arrangement, within a few weeks. The music partner may trust that the Improvisation Academy provides a good piano lesson.
  • When a music partner has registered for a workshop, course or training programme, the Improvisation Academy trusts that the music partner pays the price agreed in advance, either the full amount before the start of the workshop, course or training programme or, at the music partner's request and by arrangement, in instalments. The music partner may trust that the Improvisation Academy provides a good workshop, course or training programme.
  • When a music partner orders a book and/or CD from the Improvisation Academy, the Improvisation Academy trusts that the music partner pays the set price, either immediately or, by arrangement, within a few weeks. The music partner may trust that the Improvisation Academy delivers the book and/or CD within a reasonable period.

Article 3 Cancellation and early withdrawal

  • In the event of cancellation or non-attendance of a piano lesson, workshop, course or training programme, the following applies:
    1. If a music partner cancels a piano lesson the day before, or earlier, the music partner does not have to pay for the lesson. If a music partner cancels a piano lesson on the day itself, for whatever reason, or does not cancel at all, the music partner pays half the price of the lesson.
    2. If a music partner cancels a workshop or course three weeks in advance, or earlier, the music partner does not have to pay for the workshop or course. If a music partner cancels a workshop or course two weeks in advance, for whatever reason, the music partner pays half the price of the workshop or course. If a music partner cancels a workshop or course one week in advance, or later, for whatever reason, the music partner pays the full price of the workshop or course.
    3. If a music partner has enrolled in the Improvisation Coach Training Programme, the Payment and delivery terms of the Improvisation Coach Training Programme apply (see Article 5 below).
  • If a music partner decides, during a workshop, course or training programme, to withdraw from it for whatever reason, the obligation to pay the full price of the workshop, course or training programme remains in force.
  • Failure to comply with the payment terms may result in exclusion from the training programme.
  • By mutual agreement between the music partner and the Improvisation Academy, and in a spirit of reasonableness, respect and trust, it is possible to deviate from articles 3.1.a, 3.1.b and 3.2.

Article 4 Cooperation and disputes

  • As already stated in article 2.1, the basis of the cooperation between the Improvisation Academy and all its music partners is mutual trust. The Improvisation Academy takes care, and feels responsible, that this trust remains intact. The Improvisation Academy expects its music partners to feel this responsibility too.
  • Should a music partner or the Improvisation Academy feel that something in the cooperation – business-wise or emotionally – is not going well, or that an expectation is not or insufficiently being met, they will raise the matter as soon as possible in order to resolve the dissatisfaction. For example through one or more conversations centred on openness and listening to each other respectfully. Should this not work, they will call in an independent third party to act as mediator.
  • Should this not work, there is a separate complaints procedure. It should be noted that the Improvisation Academy will do everything it can to avoid ending up in this complaints procedure, because a pleasant cooperation is exactly what it considers super important! And fortunately we have never had to activate the complaints procedure. But still, just in case, the formal complaints procedure follows here:
    1. A complaint can only be submitted in writing by post (Improvisatie Academie, Dorpsstraat 39, 7975AN Uffelte, the Netherlands). Include your email address and telephone number with the complaint.
    2. A complaint will always be treated confidentially.
    3. Within seven days of the Improvisation Academy receiving your complaint, you will receive an email confirming and registering your complaint. Should you not receive this email, please report this to the email address robijntilanus@gmail.com.
    4. The entire handling and settlement of the complaint takes place by email, via the specific email address robijntilanus@gmail.com.
    5. Complaints are initially handled by Robijn Tilanus, founder and owner of the Improvisation Academy.
    6. A decision on a complaint is given within 4 weeks of submission.
    7. If you do not agree with the decision, an appeal can be lodged with an external party. To do so, the complaint must be submitted to Mr M. Kooperberg, klachten@kooperberg.nl, quoting 'klachtenprocedure Opleiding tot Improvisatiecoach'. You must also state on what grounds you disagree with the decision.
    8. The external appeals body gives a decision, which is binding on the Improvisation Academy, within 2 months of receiving the appeal. Any consequences of the decision are settled within 4 weeks.
    9. If the stated deadlines for handling the complaint or appeal, or for settling the decision, cannot be met, for example because further investigation is needed, you will be notified by email within those deadlines. That email explains the delay and gives an indication of when a decision is expected.
    10. Complaints and the way they were handled are registered and kept for a period of 1 year.
    11. The Improvisation Academy expresses the wish that, once the complaint has been settled, the air will have cleared and there will once again be plenty of room for positivity and the joy of improvisation!
